Abstract |
This essay compares the debates surrounding the Schund-und-Schmutz laws of 1926 and 1953, and demonstrates how conservatives manipulated language to exaggerate the dangers of popular culture. The author argues that the statutes against “trash reading” created an arbitrary bureaucratic and judicial right to determine what constituted a danger to German youth and society, and reveals the paradox between “legal censorship” and the guarantee of free speech expressed in the democratic Constitutions of the Weimar Republic and the Federal Republic of Germany.
